Terms of Use
1. Scope
These Terms of Use govern the use of the Means AI app (hereinafter the “App”).
The provider of the App is:
Beate Faupel
Brockhäger Str. 3
33428 Harsewinkel
Germany
Email: support@means-ai.app
(hereinafter the “Provider”).
By using the App, these Terms of Use apply to the extent applicable in each case.
2. Description of the Service
Means AI provides AI-assisted analyses of texts. In particular, the App may analyse linguistic characteristics such as tone, emotional signals, possible meanings, and notable communication features, and may indicate possible signs of pressure, manipulation, or comparable communication patterns.
The results provided do not constitute objective truths, verified findings about the actual intentions of other persons, or evidence. They are algorithmically generated assessments based on the text entered in each case and on automated AI models.
The App serves as a tool for reflection, information, and support.
3. No Substitute for Professional Advice
In particular, outputs generated by the App do not constitute legal advice, medical advice, psychological or psychotherapeutic advice, or any other professional advice.
Decisions with significant personal, health-related, legal, financial, or other consequences should not be made solely on the basis of the App’s analysis results.
Users are responsible for entering only content that they are authorised to use and process. This applies in particular to texts containing personal data of other persons, such as chat messages, emails, or other private communications.
4. Permitted Use
The App may only be used in accordance with applicable law and these Terms of Use.
In particular, it is prohibited to:
- enter unlawful content or use the App for unlawful purposes,
- infringe personality rights, copyrights, data protection rights, or other rights of third parties,
- use personal data of third parties without the relevant authorisation,
- analyse content that the user is not authorised to use or process,
- use the App to monitor, intimidate, expose, defame, or harass other persons,
- use the App specifically to manipulate or harm other persons,
- use the App’s results as the sole basis for automated decisions about other persons.
Users are responsible for the content they enter and for its lawful use.
5. Availability and Changes to the App
The Provider endeavours to make the App available reliably. However, uninterrupted, completely error-free availability at all times cannot be guaranteed.
Functions of the App may be developed further, changed, restricted, or discontinued for technical, legal, security-related, or economic reasons.
Rights already acquired and mandatory statutory claims remain unaffected. Where statutory provisions impose specific requirements for changes to digital products, those requirements also remain unaffected.
6. Particular Features of AI-Assisted Analyses
The analyses are generated using automated AI systems.
Despite careful design, AI systems may produce incomplete, inaccurate, contradictory, or misleading results. Similar or identical texts may also be interpreted differently under certain circumstances.
The analysis results should therefore be understood as supporting assessments and should always be considered in their actual context.
7. Data Protection
Information on the processing of personal data is contained in the App’s Privacy Policy.
Texts entered into the App may contain personal data. Users are responsible for checking whether they are authorised to enter and process the relevant content.
8. Costs, Credits, and Billing
Certain functions of the App are subject to a charge. Credits are purchased through Apple In-App Purchases.
Payments are processed by Apple. The Provider does not receive full payment information such as credit card numbers or bank account details.
One credit entitles the user to carry out one analysis unless otherwise stated in the App.
Credits purchased through Apple In-App Purchases do not expire. Unused purchased credits can be reassigned using the purchase-restoration function offered in the App, provided that the required App Store purchase history is available and can be verified.
A credit is deemed used as soon as a valid analysis result has been technically generated or provided by the analysis system.
Apple’s applicable terms and procedures additionally apply to payments and, where applicable, refunds processed by Apple.
Mandatory statutory consumer rights, in particular rights relating to digital products that are not provided or are provided defectively, remain unaffected.
9. Intellectual Property
The App, including its design, texts, graphics, trademarks, logos, software components, and other proprietary content, is protected under the applicable statutory provisions.
Reproduction, modification, distribution, or other use outside the intended use of the App is permitted only where a statutory permission applies or the Provider has given prior consent.
10. Liability
The Provider is liable in accordance with the statutory provisions for damage caused intentionally or through gross negligence.
In the event of a slightly negligent breach of material contractual obligations, liability is limited to the foreseeable damage typical of the contract, to the extent permitted by law.
The above limitations of liability do not apply to damage resulting from injury to life, body, or health, or in other cases in which limitation of liability is excluded by law.
For decisions made by users on the basis of analysis results, the Provider bears no liability beyond that provided for by law.
Mandatory statutory consumer rights remain unaffected.
11. Changes to these Terms of Use
These Terms of Use may be amended where there is an objective reason to do so due to legal, technical, or functional developments.
Users will be informed of material changes in an appropriate manner. Where consent is required for a change, such consent will be obtained.
Mandatory statutory rights remain unaffected.
12. Final Provisions
The law of the Federal Republic of Germany applies.
For consumers whose habitual residence is in another country, mandatory consumer protection provisions of that country remain unaffected.
If individual provisions of these Terms of Use are or become wholly or partly invalid, the validity of the remaining provisions remains unaffected.
